DESIGN POLICY
SEATTLE DESIGN LAB
Design Standards, Confidentiality & Intellectual Property Policy
Effective Date: 12/15/2025
This Design Standards, Confidentiality & Intellectual Property Policy (the "Policy") governs the design services provided by Seattle Design Lab ("we," "us," or "our") through SeattleDesignLab.com. By engaging our design services, you (the "Client") acknowledge that you have read, understood, and agreed to the terms set forth below.
1. CONFIDENTIALITY AND NON-DISCLOSURE AGREEMENTS (NDAs)
• Clients who wish to keep their project, deliverables, mockups, and related design work confidential must provide a signed Non-Disclosure Agreement ("NDA") to Seattle Design Lab at the outset of the engagement, prior to the commencement of any design services.
• Together with the NDA, the Client should communicate, in writing, its preference that Seattle Design Lab refrain from using any mockups it produces in its marketing materials or website image assets.
• An NDA, and any related restriction on the use of mockup imagery, is effective only if it is received and acknowledged by Seattle Design Lab before design services begin.
2. USE OF MOCKUPS AND DESIGN ASSETS
• In the absence of a signed NDA provided before design services begin, Seattle Design Lab reserves the right to use, display, reproduce, publish, and distribute any mockups, drafts, concepts, revisions, or final imagery it produces during the course of the engagement.
• Permitted uses include, without limitation, marketing campaigns, advertisements, portfolio pieces, case studies, social media content, and display on our website at SeattleDesignLab.com.
• This right applies to all imagery created by Seattle Design Lab, regardless of whether a given mockup or design was ultimately selected, approved, purchased, or used by the Client.
3. DEFAULT RIGHTS WHERE NO NDA IS PROVIDED
• If no NDA has been provided by the time Seattle Design Lab's design services commence, the Client is deemed to have consented to the uses described in Section 2.
• The absence of an NDA at the start of services serves as the Client's acknowledgement that no confidentiality restriction applies to the mockup and design imagery produced during the engagement.
• Providing an NDA after design services have already begun does not retroactively restrict Seattle Design Lab's rights to imagery created prior to receipt of that NDA.
4. TRADEMARK AND BRANDED IMAGERY
• Clients who engage Seattle Design Lab without providing the aforementioned NDA forfeit any and all rights to assert or enforce trademark or otherwise branded imagery claims against Seattle Design Lab in connection with the display or use of mockups and design assets produced during the engagement.
• This waiver is limited to imagery created by Seattle Design Lab in the course of the engagement and to the permitted uses described in this Policy.
5. GENERAL TERMS
• This Policy forms part of, and is incorporated into, the agreement between Seattle Design Lab and the Client.
• Seattle Design Lab may update this Policy from time to time; the version in effect at the start of an engagement governs that engagement.
• If any provision of this Policy is found to be unenforceable, the remaining provisions will continue in full force and effect.
